Judgment
Anil Kumar, J.—Learned counsel for the petitioner, on instructions, states that discharged certificate dated 28th February, 2012 has been
issued by respondent Nos. 1 to 7 and as far as relief claimed against the respondent Nos. 1 to 7 is concerned, the writ petition has become
infructuous. The petitioner was offered the appointment by respondent No. 8, IDBI Bank to the post of Assistant Manager, Grade-I by letter
dated 7th October, 2011.
The petitioner was directed to join on the said post in terms of the said letter within one and a half months from the date i.e. by 21st November,
2011.
Time to join the said post had been extended by respondent No. 8 till 30th December, 2011.
This Court, however, considering the facts and circumstances had passed the interim order dated 20th December, 2011 directing respondent
No. 8 to keep one post of Assistant Manager vacant till the next date of hearing which order has been extended by the Court from time to time.
Learned counsel for respondent No. 8 on instructions, states that respondent No. 8 has kept one post of Assistant Manager vacant for the
petitioner in terms of the order passed by this Court which has been renewed and offered to the petitioner by letter dated 7th October, 2011.
Since the discharged certificate has been issued by respondent Nos. 1 to 7 to the petitioner, a copy of which has also been given to respondent
No. 8 today, the petitioner is entitled for the appointment to the said post in terms of letter of appointment dated 07.10.2011 issued by respondent
No. 8.
Respondent No. 8 is, therefore, directed to proceed further with appointment of the petitioner in terms of letter dated 7th October, 2011.
The petitioner shall report to respondent No. 8 within one month from today in terms of letter dated 7th October, 2011 on the terms and
condition stipulated there and shall also take such steps as stipulated therein.
A copy of this order be given dasti to learned counsel for the parties.
Writ petition is disposed off in terms hereof. All the pending applications are also disposed off. Parties are left to bear their own costs.
