C.P Vidhyadaran vs Vigilance Director

This writ petition has been filed aggrieved by the alleged inaction on the part of the respondents in taking final and proper action on Exts.P1 and P2 complaints.

The petitioner is the former employee of the M/s.Plantation Corporation of Kerala Limited. He preferred Ext.P1 complaint to the 1st respondent highlighting certain illegal action undertaken by some of the officers of the Corporation. He specifically alleged that there is illegality in the grant of time bound higher grade, unscientific adoption of ratio promotion, grant of medical reimbursements in respect of private hospitals etc. Since, there was no action on Ext.P1 complaint, he preferred Ext.P2 representation as reminder to the 1st respondent. Since there was no response to Ext.P2 also, he approached this Court.

I have heard Sri.P.G.Jayashankar, the learned counsel for the petitioner and Smt.S.Rekha, the learned Senior Public Prosecutor.

The learned Government Pleader was directed to get instructions. The learned Senior Government Pleader submitted a report prepared by the Deputy Superintendent of Police, Vigilance & Anti-Corruption Bureau. It is stated in the report that thorough enquiry has been conducted on Exts.P1 and P2 complaints and it was found that all the allegations raised by the petitioner in those complaints are relating to service matter and there is nothing to suggest that the offence under the Prevention of Corruption Act is involved. It is also stated that report to that effect has already been forwarded to the Director, Vigilance & Anti-Corruption Bureau.

In these circumstances, this Writ Petition (Crl.) is closed with liberty to the petitioner to challenge the report in accordance with law.

The 1st respondent shall furnish a copy of the report to the petitioner within one week from today.
