Ld. Counsel appearing for the second Appellant has filed MA No. 515 of 2017, seeking restoration of the Revision Petition, which had been dismissed for non-prosecution vide order dated 03.03.2014, on the ground that a wrong date was noted.
Ld. Counsel appearing for the Respondent/Complainant submits that she has no objection if the Application is allowed and the Appeal is restored.
In view of the above, Application, seeking condonation of delay in filing application for restoration, is allowed and the delay is condoned, however, on payment of costs of 10,000/- to the Respondent/Complainant. The Application for restoration is also allowed and the Appeal is restored to its original position. Appeal
Ld. Counsel appearing for the second Appellant submits that First Appeal No. 540 of 2015, preferred by the said Appellant, has been allowed by this Commission vide order dated 10.12.2015. As it is observed from the record that in this case there is no separate appeal preferred by the second Appellant, he is directed to file the requisite amended memo of parties.
Post the Appeal and remaining applications for directions on 23.02.2018.
