M.A. No. 164 of 2024 ( for Restoration) with I.A. No. 3489 of 2024 (for Condonation of delay)
The instant miscellaneous application being M.A.No.164 of 2024 has been filed seeking restoration of the revision petition and recall of the Order dated 11.01.2024 whereby the second appeal was dismissed in non-prosecution. Along with it, an interlocutory application being I.A. No 3489 of 2024 seeking condonation of delay has also been filed.
In the interest of justice and for the reasons stated in the application, the delay in filing the M.A. No. 164 of 2024 stands condoned.
Heard the learned counsel for the applicant / appellant. Perused the entire material on record including inter alia the Order dated 11.01.2024 and the application seeking restoration of the Second Appeal.
Learned counsel for the applicant / appellant has tried to explain the circumstances which led to the dismissal of the Second appeal vide Order dated 11.01.2024 passed by this Commission.
The grounds taken in the application for restoration of the second appeal are sufficient. Accordingly, the Order dated 11.01.2024 passed by this Commission stands recalled and the second appeal stands restored to its original number.
List on 01.04.2024.
