Judgment
Jasbir Singh, J.—Proceedings under the Contempt of Courts Act, 1971 were initiated against the contemner on a reference sent by the District Judge Rohtak vide letter dated 19.5.2011, in which it was stated that in the Court of Civil Judge Junior Division, the contemner has used intemperate language. His tone and tanner was highly condemnable and by uttering indecent words, an attempt was made to lower the dignity of the Court and the legal profession.
At the time of hearing, the contemner has shown remorsefulness and made a request to tender an apology. He filed an affidavit dated 21.12.2011, tendering unconditional apology. Relevant contents of the affidavit read thus:-
That the deponent sincerely regrets about the incident in question and hereby tenders his unconditional and unqualified apology. The deponent holds every Court of Law in highest esteem and has unwavering faith and regard for this august and indispensable institution.
Thereafter, vide order dated 21.12.2011, he was directed to file similar affidavit before the officer below in whose Court the misbehaviour by him, was reported.
Report dated 1.2.2012 has been received from the officer concerned, in which it is stated that the contemner has filed affidavit showing regret and tendering unqualified apology. The contemner is present in Court and has assured the Court that in future he will not repeat any such act which may lower the dignity of the Courts.
In view of above, we accept unconditional apology tendered by the contemner and drop the proceedings.
The contempt petition stands disposed of.
