ORDER
IA 642(MB)2025
This is an Application filed by Parijata Trading Private Limited on behalf of SCC/Applicant under Rule 11 of the NCLT Rules, 2016 seeking change/replacement of the present Liquidator Mr. Anil Kashi Drolia with Mr. Nitin O. Kothari.
The Counsel for the Applicant submits that the SCC meeting held on 13.01.2025 has resolved to appoint a new Liquidator in place of the existing Liquidator Mr. Anil Kashi Drolia with 95.42% voting shares.
The Counsel for the Applicant further submits that the new Liquidator Mr. Nitin O. Kothari has provided consent letter dated 11.01.2025 to act as Liquidator of the CD, which is annexed as Exhibit B.
In view of the above, it is prayed that the new Liquidator Mr. Nitin O. Kothari may be appointed in place of the erstwhile Liquidator.
Having heard both the Counsel for the Applicant and erstwhile Liquidator, we allow the IA subject to condition that the new Liquidator possesses valid Authorisation for Assignment (AFA).
Accordingly, the present Application i.e. IA 642(MB)2025 stands allowed and disposed of.
