Judgment
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is an accused in connection with Azadnagar (Mango) P.S. Case No. 529 of 2015, corresponding to G.R. No. 3419 of 2015, registered for the offence punishable under Sections 420/406/467/468/471/323/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that one complaint case no. 991 of 2015 was instituted and on the basis of that complaint case, the petitioner who is, Lalita Singh, who has been wrongly cited as Shyama Rani, has been lodged in jail. It has been further submitted that the petitioner has not committed any offence and that the allegation against the petitioner is fabricated and concocted and that the complainant has impersonated herself as Smt. Lalita Singh. It is further submitted that the present petition is being filed by Ram Chandra Singh, who is the Parvikar of petitioner, himself states that woman in custody in this case is actually Smt. Lalita Singh, who is his wife. It is further submitted that Shyama Rani was not being produced in the learned court below and it will be in the interest of justice if, the bail of the petitioner is granted so that both the ladies (Lalita Singh and Shyama Rani) may be able to pursue the case as per law.
Learned A.P.P. opposes the prayer for bail and has submitted that it is a case of impersonation and , therefore, she does not deserve bail.
Having heard learned counsel for the petitioner and having gone through the case records, present petitioner, named above, is directed to be released on bail on executing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamshedpur in connection with Azadnagar (Mango) P.S. Case No. 529 of 2015, corresponding to G.R. No. 3419 of 2015.
