Learned advocate Mr. Ritesh D. Patadia appearing for the petitioner seeks permission to withdraw this petition in view of the fact that the appeal preferred by the borrower is listed before the Debt Recovery Appellate Tribunal, Mumbai on 18.10.2023. He states that since the Debt Recovery Appellate Tribunal, Mumbai has while deciding the application for waivers on pre-deposit, granted stay in favour of the borrower, the respondents may be heard on 18.10.2023 and thereafter, after hearing the respondent, the Debt Recovery Appellate Tribunal, Mumbai may pass any further order taking into consideration the submissions made by the Bank in respect of the stay application.
In view of that permission to withdraw this petition as prayed for is granted. The Debt Recovery Appellate Tribunal, Mumbai is directed to hear the stay application pending before the Debt Recovery Appellate Tribunal, Mumbai in accordance with law on 18.10.2023 or as early as possible.
