Judgment
Grievance in the application is against establishment of Material Recovery Facility (MRF) at Ullawas village near Section 61, Gurugram by the Municipal Corporation, Gurugram. According to the applicant, it will be source of pollution as requisite buffer zone of 200-500 mtrs. has not been established. It is close to community/club facilities. No consent to establish/operate has been taken from the State PCB. The applicant made representation dated 17.10.2022 but no action has been taken.
While there is no doubt that environmental norms have to be followed in establishing and operating Waste Management Facility and requisite consents obtained, setting up thereof in urban areas with scarce open lands cannot be wished away. The applicant has not pointed out any other alternative nor produced any scientific data to show any damage to the environment by the Facility in question.
Since we are not inclined to entertain the application except for directing compliance of norms, if not being followed, learned Counsel for the applicant prays for withdrawal of the application.
