Judgment
This writ petition is filed seeking the following relief:
“ … to issue Writ, Order or Direction more particular one in the nature of Writ of Mandamus, to declare the inaction of the respondents in providing police security to the Petitioner and his family members, as illegal, arbitrary, violative of principles of natural justice and against all settled principles of law, in spite of receiving the representation dt.04.08.2022 and consequently direct the Respondent authorities to provide police security to the Petitioner and his family members till disposal of ED File No.T‐ 3/HYZO/100/2022 dt.27.07.2022 and to pass such other order or orders as this Hon’ble Court may deem fit and proper in the interest of justice.”
Sri B.Chandrasen Reddy, learned senior counsel, representing Smt.B.Namrata Reddy, learned counsel for the petitioner, submits that the petitioner has given a representation to the Commissioner on 4.08.2022 requesting for police protection, as there is threat to the petitioner and his family members. He submits that the Enforcement Directorate has registered a case against the petitioner and others under the Foreign Exchange Management Act on 27.07.2022 and they have conducted raids at the residence, office, farmhouse and other places of the petitioner. He further submits that the media has continuously creating hype over the investigation and they also branded the petitioner as prime accused. It is stated that there is threat to the petitioner’s life and when he has made an application to the respondents seeking police protection, the respondents ought to have considered the same in the light of G.O.Rt.No.655 dated 13.03.1997.
Sri A.Manoj Kumar, learned Assistant Government Pleader for Home, submits that he will come up with a detailed counter-affidavit.
When a representation is made on 04.08.2022 stating that there is a threat to the life of the petitioner, the respondents ought to have considered the same in the light of G.O.Rt.No.655 dated 13.03.1997.
Accordingly, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 4.08.2022 in the light of G.O.Rt.No.655 dated 13.03.1997, within one week from the date of receipt of a copy of this order. No order as to costs.
Miscellaneous applications, pending if any, shall stand closed.
