Narendra Nath Tiwari, J.—In this writ petition, the Petitioner has prayed for a direction on the Respondents to review the order of fixation of the Petitioner''s pay and refix the pension in accordance with the prescribed rule and also for payment of arrears of monetary benefit which the Petitioner is entitled to get.

It has been stated that the Petitioner had taken voluntary retirement under the V.R.S. Scheme with effect from 30th July, 1996. The Petitioner was entitled to receive his pension to be calculated in accordance with the prescribed rate. The Petitioner''s pension should have been fixed @ Rs. 542.42 per month, but instead thereof the Petitioner has been given pension at the lower rate i.e. Rs. 368/ per month. The Petitioner filed representation before the concerned Respondents, but the same was not heeded upon.

Learned Counsel appearing on behalf of the Respondents submitted that No. representation has been filed by the Petitioner regarding his claim made before this Court. If any representation is filed by the Petitioner, the same shall be considered and appropriate order shall be passed.

Considering the above, this writ petition is disposed of, giving liberty to the Petitioner to file representation along, with a copy of this order, before the Project Officer, Nudkhurkee Open Cast Project, Block II Area, Nawagarh, Dhanbad Respondent No. 2. On the receipt of the representation, the said Respondent shall consider the same and pass appropriate order in accordance with law.
