This Appeal (first) under section 14A(2) of the SC & ST (Prevention of Atrocities Act, 1989 is preferred against the order dated 11.09.2025 passed in BA No.713/2025 by Special Judge (SC&ST (POA) Act, 1989, Ratlam whereby the trial court has rejected the application filed under section 483 of the B.N.S.S., 2023 by the appellant seeking bail in connection with crime no.279/2025 registered at police station- Sailana, District Ratlam for the offence punishable under sections 115 (2), 296, 351 (3), 3 (5), 117 (2) & 118 (2) of Bhartiya Nyaya Sanita, 2023 and Section 3 (1)(r), 3(1)(s) & 3(2) (v-a) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 for committing the offences towards victim Manoj, Rohit & Ankit.

The dispute resulting in the offence occurred when fishes from the bus belonging to co-accused Dhama @ Dharmendra was being unloaded.

Learned counsel appearing for the victim Manoj has objected the criminal appeal submitting that Manoj sustained injuries in the head.

Counsel for the State as well has opposed the criminal appeal.

The statement of the victim Manoj is to the effect that present appellant caused injury by slapping with the fish. Considering the role of the appellant, the criminal appeal is allowed and the appellant - CHETAN is directed to be released on bail upon his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court for his appearance before that Court, as and when directed, during the pendency of trial and shall also abide by the conditions enumerated under section 480 (3) of the BNSS, 2023.
