This is first criminal appeal under section 14A (2) of the SC & ST (Prevention of Atrocities) Act, 1989 is preferred against the order dated 06.10.2025 in BA No.1210/2025 by Special Judge, SC/ST (POA) Act), 1989 Dewas (M.P.) whereby the trial court has rejected the application under section 483 of the B.N.S.S., 2023 seeking bail in connection with crime no.357/2025 registered at police station- Bagli, District- Dewas (M.P.) for the offence punishable under sections 296, 118(2), 115(2), 351(3), 3(5) of the B.N.S., 2023 and sections 3(1)(D), 3(1)(dh) and 3(2)(v) of the SC & ST (Prevention of Atrocities) Act, 1989.

Counsel for the appellant submits that the appellant is innocent and he has been falsely implicated in this case. The appellant is in custody since 28.09.2025. Appellant has no criminal antecedents. The allegations against present appellant Ashwin@Bhawri is for causing injuries to injured Anand by slaps and fists. The investigation is over and charge sheet has been filed. Hence, prayer is made for grant of bail to the appellant.

Considering the facts and circumstances of the case and the role attributed by the present appellant, this criminal appeal succeeds and the appellant- ASHWIN @ BHAWRI is directed to be released on bail upon his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the trial court for his appearance before that Court, as and when directed, during the pendency of trial and shall also abide by the conditions enumerated under section 480 (3) of the B.N.S.S., 2023.
