Judgment
Heard Sri Ravi Teja Padiri, learned counsel for the petitioner, Sri J.Krishna Praneeth, learned Assistant Government Pleader for respondent Nos.1 to 5, and Ms.Sodum Anvesha, learned counsel for the respondent No.6/father.
On 06.07.2026, a Co-ordinate Bench passed the following order :
"Heard Sri Mareedu Sasidhar, learned counsel for the petitioner; Sri Krishna Praneeth, learned Assistant Government Pleader for respondent Nos.1 to 5.
2.Ms. Sodum Anvesha, learned counsel appears and submits that she has instruction to appear for respondent No.6 and would file vakalat in due course.
3.Respondent No.6 is present with the minor daughter. The petitioner is also present.
4.From the submissions advanced it appears that there is some matrimonial disputes between the wife and husband (the petitioner and respondent No.6). The minor daughter is with the respondent No.6.
5.Learned counsels for the parties submit that the parties are willing to resolve the dispute through process of mediation. There are fair chances of amicable settlement.
6.The petitioner submits that she wants to meet the daughter.
7.Respondent No.6 submits that he has no objection in meeting the mother to the daughter.
8.Since the daughter is present today, we provide that the parties shall approach the mediation and conciliation centre of this Court today itself. The Mediation and Conciliation Centre shall appoint a mediator. The first session shall take place today itself i.e., 06.07.2026.
9.Appropriate arrangements shall be made for meeting the mother with the daughter during mediation proceedings.
10.The subsequent dates for sessions shall be fixed by the mediation centre. The mediation centre through its mediators shall make endeavour to complete the proceedings within a period of three months from the date of first appearance and submit the report to this Court.
11.Post on 06.10.2026 along with the report of mediation centre.
12.Let the copy of this order be sent to the mediation centre of this Court with the particulars of this case."
Learned counsel for respondent No.6/father submits that the mediation proceedings are ongoing and that some sessions have already taken place.
The grievance raised by learned counsel for the petitioner is that the petitioner/mother was not able to meet the child during the mediation proceedings, on 17.07.2026, whereas, during the remaining sessions, the petitioner could meet the child. He submits that, in addition to the dates fixed at the Mediation Centre on which dates the petitioner has been permitted to meet the child, the petitioner is also willing to exercise visitation rights at Kadapa, where the child is residing with respondent No.6/father, and also to have contact right with the child on phone and through video conference.
Learned counsel for respondent No.6 submits that the respondent No.6/father has no objection to the petitioner exercising such visitation rights coming at Kadapa, as well.
Pursuant to the order dated 06.07.2026, this matter is already fixed for 06.10.2026 along with the report of the mediator. The matter was directed to be listed today on the Court slip and the request made by the petitioner's counsel on 15.09.2026 for consideration of the visitation rights, pursuant to I.A.No.2 of 2026 filed by the petitioner.
It is provided further, infurtherence of the order dated 6.07.2026 as an interim measure, that the petitioner may meet the child at the Mediation Centre of the District Legal Services Authority (DLSA), Kadapa, on the following working Saturdays, i.e., 19.09.2026, 26.09.2026 and 03.10.2026, between 11:00 a.m. and 4:00 p.m. The District Legal Services Authority (DLSA), Kadapa, through its Secretary, is requested to make the necessary arrangements for the exercise of the visitation rights by the petitioner/mother. Respondent No.6/father shall accompany the child to the said Centre on the aforesaid dates without causing any obstruction. The petitioner shall intimate the DLSA in advance regarding her intention to exercise the visitation rights on the said dates.
The custody shall continue with the father.
List on 06.10.2026, as already fixed.
A copy of this order be communicated to the Secretary, District Legal Services Authority (DLSA), Kadapa, for necessary action.
