Heard on application filed under Section 439 of Cr.P.C. filed on 23.06.2021 on behalf of Charandas Bagde, who was arrested on 01.06.2021 in
connection with the Crime No. 26/2021 registered at Police Station, Lodhikheda, District Chhindwara for the offence punishable under Section 34 (2)
of M.P. Excise Act.
It appears from the record that 55 liters of country made liquor has been seized from the possession of the applicant. The applicant was fled away
from the spot. Thereafter, he was arrested on 01.06.2021. Since 01.06.202, he is confined in custody. Upon query, it is submitted by the State that this
is the first case against the applicant and there is no any criminal background of the applicant.
Therefore, looking to the quantity seized, custody period, first offence and other circumstances of the case, the application is allowed. Applicant
Charandas Bagde be released on bail upon his furnishing a bail bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) and a personal bond of
the same amount to the satisfaction of the trial Court.
At the time of releasing from custody, all the instructions issued by the government related to Covid-19 shall also be followed by the concerned
authority.
Accordingly, this M.Cr.C. stands allowed.
