Arguments heard upon the application filed under Section 439 of Cr.P.C on 29.09.2020 on behalf of the applicant Jaspal Singh Bhogal, who is confined in custody since 12.09.2020 in connection with Crime No.69/2020, registered at Police Station Excise Circle 4(BA) Bhopal (M.P.) for the offence under Section 34(2) of M.P. Excise Act, 1915.

It appears from the case diary that 80.25 bulk liter of English liquor was seized from the possession of the applicant.

Upon query, State informs that as the per case diary this is the first case against the applicant. Applicant having no any criminal background.

Therefore, looking to the over all circumstances and after taking into consideration the present situation arising out of Covid-19, without commenting upon the merits of the case, the application is allowed. It is directed that the applicant Jaspal Singh Bhogal shall be released on bail upon his furnishing a bail bond worth Rs.50,000/- (Rupees Fifty Thousand only) and a personal bond of the same amount to the satisfaction of the trial Court.

It is directed that the applicant shall abide by the conditions as enumerated under Section 437(3) of the Cr.P.C.

At the time of releasing the applicant from custody, all the instructions issued by the Government related to Covid-19 shall also be followed by the concerned authorities.

Accordingly, this M.Cr.C. stands allowed.
