Learned AGA draws our attention to our order dated 29.10.2024 which is structured on a premise that the service of Petitioner is spotless. She points out that the disciplinary enquiry is half a way through and presently it is at the stage of Second Show Cause Notice and therefore, obviously service cannot be said to be spotless. She also tells us that the Petitioner has been in Chickmagaluru since last eight years which militates against the Transfer Guidelines, retention period being two years only. There is no reason to doubt this version, since it is a matter on record.

Learned counsel appearing for the Petitioner submits that his client is at the verge of retirement and therefore, he should be permitted to remain at Chickamagaluru itself. This is bit difficult to countenance. Having so argued, now in all fairness he submits that his client has already reported for duty at Chamarajanagara pursuant to Transfer Order in question; therefore, Petition may be dismissed as having become infructuous. In view of this fair stand, nothing survives for consideration in the matter.

In the above circumstances, Petition is disposed off, costs having been made easy.
