Judgment
This criminal miscellaneous petition has been filed under section 482 Cr.P.C by the petitioner with a prayer for modification of the order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019.
Heard the parties through video conferencing.
It is submitted by the learned counsel for the petitioner that the order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019 be modified by substituting the condition of furnishing bail bond with two sureties with furnishing bail bond with cash security of Rs.25,000/- as the petitioner is an old lady and being an ordinary resident of Kolkata, she has no known person at Ghatshila to stand sureties for her. It is next submitted that the petitioner is ready and willing to deposit cash security of Rs.25,000/-. Hence, it is submitted that the order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019 be modified accordingly and the time to surrender before the court below in terms of the said order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019 be also extended for six weeks.
Considering the aforesaid submission of the learned counsel for the petitioner and the facts of the case, the order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019 is modified as under:-
"Hence, in the event of her arrest or surrender within a period of six weeks from the date of this order, she shall be released on bail on furnishing personal bond for Rs. 25,000/- (Rupees Twenty Five Thousand) and on depositing cash security of Rs.25,000/- to the satisfaction of learned A.C.J.M., Ghatshila, in connection with Ghatshila P.S. Case No.101 of 2018 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish her mobile number and a copy of her Aadhar Card in the court below with the undertaking that she will not change her mobile number during the pendency of the case subject to the conditions laid down under section 438 (2) Cr. P.C."
The order dated 26.11.2019, passed in A.B.A. No. 8220 of 2019 is modified to the aforesaid extent only.
This criminal miscellaneous petition is disposed of accordingly.
