Chandra Bhushan Prasad vs The State of Bihar and Others

Ajay Kr. Tripathi, J.—Heard learned counsel for the petitioner and learned counsel for the State. Petitioner is a former employee of the Police Department. His grievance is that he has made contributions, monthly, towards what is known as Threft Account'' which was being operated by the Bihar Police Co-operative Society. After his retirement the "Society is dilly dallying in making payments to him. Several directions have even been issued by the Registrar, Co-operative Societies but even then necessary payments are not being made to him. In fact they have accepted the claim but due to the financial position they have expressed their inability to release the amount in one go. This Court would not like to comment on the work of the Co-operative Society in question because it will be for the competent authority especially the Registrar, Co-operative Societies to look into such matters. In so far as the claim of the petitioner is concerned the Registrar, Cooperative Societies is hereby directed to take steps by way of a follow-up action in terms of his earlier directions which is contained in Annexure-5 and is dated 5.3.2003. He shall ensure that the earlier directions issued by him is not an empty formality, he may use whatever powers he has within the parameters of law to ensure payment of the claim of the petitioner preferably within a period of four months from the date of production/ ''communication of a copy of this order.

This writ application is disposed of with the above direction.
