Judgment
This is an application for anticipatory bail filed under Section 438 of the Code of Criminal Procedure by the accused in Crime No.178 of 2021 of Pothencode Police Station. The offence alleged is under Section 332 of the Indian Penal Code.

This is a case where a police man was attacked by the petitioner. Considering the nature and circumstances of the case, I am not inclined to invoke the extraordinary jurisdiction vested with this Court under Section 438 of Cr.P.C.. The learned counsel for the petitioner submitted that the petitioner is prepared to surrender before the Investigating Officer. Hence, this application is disposed of as follows:
The petitioner shall surrender before the Investigating Officer within ten days from today. In the event of his arrest, , after interrogation, he shall be produced before the jurisdictional Magistrate. If the petitioner moves any bail application, the same shall be considered and disposed of by the jurisdictional Magistrate on the same day itself.
