Heard learned counsel for the parties.

The petitioner was allowed provisional anticipatory bail by a Bench of this Court on 27.07.2015 in Cr. Misc. No.29144 of 2015 in connection with Complaint Case No.2924C of 2013 pending before the court of learned Chief Judicial Magistrate, Patna. A copy of the order is at Annexure-3. The relevant portion of the order reads as follows:

"The court below shall make efforts for reconciliation between the husband and the wife. If the dispute is resolved, the provisional bail granted to the petitioner shall be confirmed and if the dispute does not resolve within six months from the date of appearance of the wife of the petitioner, the court below shall pass order in accordance with law on the provisional bail of the petitioner."

In view of the aforesaid direction, the learned court below passed following order on 17.02.2018.

"अभियुक्त चन्दन साहनी की औपबंधिक जमानत दिनांक 21.11.2015 को सूचिका परिवादी के उपस्थित होने के बाद छः माह हेतु दिया गया था। परन्तु छः माह बाद भी औपबंधिक जमानत संपुष्ट नहीं किया गया ना ही कोई उचित आदेश पारित किया गया। अभियुक्त एवं परिवादी के बीच मामले का समाधान भी नहीं हुआ। अभियुक्त के छः माह की औपबंधिक जमानत की अवधि समाप्त हो चुकी है। अतः अभियुक्त का बंधपत्र रद्द किया जाता है। कार्यालय अभियुक्त के विरूद्व अजमानतिय अधिपत्र निर्गत करें। वाद दिनांक 5.5.18 वास्ते उपस्थिति।"

The order of the learned court below is consistent with the direction of this Court while granting provisional anticipatory bail to the petitioner. Hence, the impugned order cannot be faulted with as resulting in miscarriage of justice. Other requirements of Section 482 Cr.P.C. is also not made out. Hence, this application is dismissed as devoid of any merit.

Petitioner may pursue other legal remedy for bail, according to law.
