Judgment

I.A. No.921 of 2023
Heard learned counsel for the petitioner and learned counsel for the State.
This I.A. has been filed for modification of order dated 01.05.2023.
Since the order, modification of which is being sought has already been acted upon, there is no scope to modify the same.
Accordingly, the I.A stands rejected.
Since the petitioner was granted bail subject to verification of criminal antecedent and it is stated, on instruction, that the petitioner was involved in a case i.e, Bariyatu P.S. Case No.159 of 2020 dated 06.07.2020, inter alia under Section 323/341/498(A)/504/506 of IPC and that the same has been compromised and even otherwise the same does not relate to any offence under the Special Act, it shall be open to the petitioner to bring the same to the knowledge of the learned Court in seisin, in the event a fresh bail application is moved before the said Court.
Learned Court in seisin is called upon to take the same into account while considering the bail application.
