I.A. No. 1671 of 2023
This I.A. has been filed for modification of order dated 18. 10.2023 stating that it could not be brought to the notice of the Court that the petitioner has one criminal antecedents which is Berhampur Town P.S. Case No. 150 of 2017 under Sections 452, 294, 323, 307, 506, 34 of IPC where the petitioner has been released on bail when the matter was heard on that day. It is further stated that as this Court had observed in paragraph-7 of the order that the petitioner has no criminal antecedent and one antecedent was found against him, the courts below have refused to release him on bail.
On 01.11.2023, the learned Sessions Judge -cum- Special Judge, Ganjam, Berhampur has refused to release the petitioner on bail on this ground.
As order dated 18.10.2023 had been passed on the submission of the learned counsel for the petitioner, I am not inclined to modify the order dated 18.10.2023.
It is however open to the petitioner to file a fresh BLAPL.
The I.A. is disposed of.
The Registry is directed to return the certified copy/true copy of the documents annexed to this I.A. to the learned counsel for the petitioner, on their substitution by attested photostat copie.
Urgent certified copy of this order be granted on proper application.
