Chandan Kumar vs The State of Bihar

Jitendra Mohan Sharma, J.—Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner apprehends his arrest in connection with Patliputra P.S. Case No. 432 of 2013 registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B read with Section 34 of the Indian Penal Code.

At the very outset, it has been submitted that the case has been compromised and joint compromise petition with permission of the court has also been filed in the court below vide Annexure-3 and 4 and the petitioner has no criminal antecedent and as such lenient view now can be taken to which the learned A.P.P. does not oppose.

Considering the submissions urged at the bar, going through the record and noticing that the informant himself entered into an illegal agreement for snatching job illegally and when not succeeded has approached the court, however, as submitted the case has been compromised and as such in case the petitioner, Chandan Kumar surrenders within one month before the court below and seeks regular bail on the basis of compromise petition then after verifying the genuineness of the compromise petition, he shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Patliputra P.S. Case No. 432 of 2013, subject to the conditions as laid down u/s 438(2) of the Cr.P.C.
