Chandan Kumar vs State of H.P. and Others

Kurian Joseph, C.J.—The writ petition is filed with the following prayer:

That Annexure P-1 may be quashed and the Respondents may be ordered to consider the case of the Petitioner for compassionate appointment afresh in the light of the law laid down in a case Beena Devi v. State of H.P.

The Petitioner seeks compassionate appointment. According to the Petitioner the same is denied on account of the fact that the father of the Petitioner belonged to Nahan Foundary which was a dying cadre. In CWP No. 6560 of 2010, Bina Devi v. State of H.P. and Anr., Annexure P-2, we have made it clear that the said objection is only to be ignored. Therefore, this writ petition is disposed of directing the Respondents to consider the case of the Petitioner by ignoring the objection that the father of the Petitioner belonged to Nahan Foundary, which was a dying cadre, and take appropriate action for compassionate appointment of the Petitioner, in case the Petitioner is otherwise eligible and entitled, within three months from the date of production of copy of this judgment along with copy of the writ petition by the Petitioner before the 2nd Respondent.

The writ petition is disposed of, so also the pending application(s), if any.
