Kurian Joseph, C.J.—The writ petition is filed with the following prayer:

That Annexure P1 may be quashed and the respondents may be ordered to reconsider the case of the petitioner for compassionate appointment in the light of the law laid down in Bina Devi V. State of H.P.

The petitioner''s application for appointment on compassionate appointment has been rejected on the ground that the petitioner''s father belonged to Nahan Foundry. That cannot be a justifiable ground as held by this Court in CWP No. 6560 of 2010 titled as Bina Devi versus State of Himachal Pradesh and another, decided on 1st December, 2010, Annexure P2.

There will be a direction to the third respondent/competent authority to consider the matter afresh, in the light of Annexure P2, judgment, ignoring the ground of Nahan Foundry employee (dying cadre). The needful shall be done within a period of four months from the date of production of a copy of this judgment alongwith a copy of the writ petition by the petitioner before the third respondent/competent authority.
