Judgment
Grievance in this application is against operation of Nova Dyestuffs Industries Pvt. Ltd., 251, GIDC Industrial Estate, Surat, Gujarat in violation of environmental norms. It is stated that in the course of its industrial activities, the unit is discharging chemicals in the open and through drains and also dumping hazardous untreated solid waste in violation of environmental norms. The applicant made various complaints to the statutory regulators who have failed to take any action in the matter.
Vide order dated 15.12.2021, the Tribunal directed the CPCB and State PCB to verify the allegations, take remedial action and file an action taken report.
In pursuance of above, an action taken report has been filed by CPCB on 14.03.2022 as follows:-
“As per Hon’ble NGT order, the joint team of RD Vadodara & Surat and GPCB has carried out the inspection of the unit (Dye and dye intermediate) on 07/02/2022. Non-compliances were found during visit, for this, a show cause notice for closure directions has issued by CPCB to the unit on 11.03.2022.”
Show cause notice annexed to the report lists the violations as follows:-
“
The Unit has not provided flow meter at ETP inlet and outlet as per the consolidated consent & authorization (CCA) granted by GPCB.
The Unit has not maintained any records of the quantity of effluent generation, treated effluent discharged to CETP and quantity of ETP sludge generated.
Treated effluent is not meeting the prescribed discharge standard of CETP inlet w.r.t. Chlorides (758 > 600 mg/l).
The Unit has not provided online connectivity of web camera and flow meter with CPCB server; as required by the CETP member units.
The Unit has not installed alkali scrubber at Sulphonator and drawing vessel (NKS plant) in accordance with CCA granted by GPCB.
The unit has not maintained records of disposal of fly ash and bottom ash of the boiler.
There is no separate system for discharge of storm water.
Designated port hole at boiler stack was not properly maintained. It was observed inhabited by birds.”
We have heard learned Counsel for the CPCB who is present. The report shows that treated effluent discharged by the unit is not meeting the inlet standards of CETP and there are other violations for which show cause notice has been issued. Remedial action needs to be ensured by the statutory regulators, following due process, including accountability for past violations on ‘Polluter Pays’ principle. An action taken report may be placed before Chairman, CPCB within two months for any further direction as may be found necessary in accordance with law.
The application is disposed of.
