Ramachandran Nair, J.—The complaint raised in this writ petition is that even in the absence of a proposal to transfer the Petitioner in Ext.P2 provisional list, when the final list was published, his name has been included. It is pointed out that the transfer is ordered to accommodate the third Respondent.

The Petitioner is presently working as Trade Instructor (Electrical) in the College of Engineering, Thiruvananthapuram. By proceedings of the first Respondent dated 28/02/2011, General Transfer order of Trade Instructors in the Technical Education Department was published. Ext.P1 is the copy of the said proceedings. Even before publishing Ext.P1, the first Respondent has published a provisional transfer list of persons proposed to be transferred in the General Transfer 2011 and directed to file appeals/objections, if any, from persons aggrieved. As the Petitioner was not included in the provisional transfer list, he did not file any objection also. It is the further case, therefore, that Ext.P1 order cannot survive. Complaining about the same, the Petitioner has approached the Director of Technical Education by Ext.P3 representation.

The learned Government Pleader pointed out that Ext.P1 transfer order will be effective from 31/03/2011. There will be a direction to the Director of Technical Education to take a decision on Ext.P3 representation within a period of one month from today and the implementation of Ext.P1, as far as the Petitioner is concerned, will be kept in abeyance till orders are passed. The Petitioner will produce a copy of the writ petition along with a copy of the judgment before the first Respondent for compliance. The writ petition is disposed of as above. No costs.
