Judgment
Pursuant to the earlier order of this Tribunal dated 26.05.2015, the Tamil Nadu Pollution Control Board (Board) has filed an affidavit stating that the Unit has been closed. The learned senior Counsel, Smt.Chitra Sampath appearing for the 6th respondent, project proponent submitted that the project proponent has complied with all the requirements of the Boardexcept of course the online effluentmonitoring analysis system for pH, TSS and temperature which is directed to be complied on or before 30.06.2015. It will be open to the unit to identify the place and install the same at an earliest point of time. In the meantime, it is not in dispute that the application for consent made by the project proponent is pending before the Board. We make it clear that it will be open to the Board to process the application and pass appropriate orders on merit and in accordance with law expeditiously.
Needless to state that any expression made by this Tribunal directing closure of the unit shall not be taken into consideration by the Pollution Control Board while passing such order.
It will always be open to the project proponent to work out its remedy in the manner known to law in the event of the Pollution Control Board passing order against them. Likewise, in the event of any order passed by the Tamil Nadu Pollution Control Board granting permission, it will be open to the project proponent to continue its operation in accordance with law.
With the above directions, the application stands disposed of. No cost.
