Judgment
B.S. Bhanumathi, J
The Writ Petition is filed under Article 226 of Constitution of India seeking the following prayer:
“… to issue an appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 1st respondent in denying the petitioner of the continuity of service and the consequential benefits, further action of the respondents in proceedings with the Departmental Enquiry against me in respect of the charge sheet dated 07.01.2010, though I was dismissed vide order dated 10.12.2012 and reinstated and once again suspended vide separate orders dated 12.04.2014 and 16.04.2014 respectively, as arbitrary, illegal, unjust, discriminatory, colourable exercise of power, contrary to the procedure contemplated under the Disciplinary Action Procedure for Workmen, contrary to the provisions of the Banking Regulation Act, contrary to the judgments of the Apex Court, violative of the Fundamental Rights guaranteed under 14, 19 and 21 of the Constitution of India and consequently direct the 1st respondent to compute the continuity of service treating the said period as on duty and pay the petitioner all the attached benefits including computation of seniority, payment of monetary and non-monetary benefits and pass such other order or orders as are deemed fit and proper in the circumstances of the case.”
Ms. P. Keerthi, learned counsel representing learned counsel for the petitioner is present. Sri V. Venkatasubbaiah, learned counsel appearing for R1 and R2 is present.
At request of the learned counsel for the petitioner to post the matter for the purpose of withdrawal, the matter is posted for today.
Accordingly, the Writ Petition is dismissed as withdrawn.
There shall be no order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
