Judgment
Hon’ble Mr. R.N. Singh, Member (J) :
The precise grievance of the applicant in the present OA is that after retirement of the applicant on attaining the age of superannuation w.e.f 31.07.2021, the respondents without issuing any show-cause notice or intimating any reason have withheld sum of Rs. 4,06,500/- from the DCRG of the applicant.
Mr. Gaya Prasad, learned counsel for the applicant submits that aggrieved of the aforesaid action of the respondents, the applicant has preferred a representation dated 09.08.2021 (Annexure A-1). However, till date, no remedial action thereon has been taken by the respondents.
Issue notice. Shri Krishan Kant Sharma, learned counsel, who appears for respondents on advance service, accepts notice.
Mr. Gaya Prasad, learned counsel for the applicant submits that the applicant shall be satisfied if the present O.A. is disposed of, at this very stage, with a direction to the respondents to consider the applicant’s aforesaid pending representation dated 09.08.2021 (Annexure A-1) and to dispose of the same in a time bound manner.
To such request of the learned counsel for the applicant, there is no objection from the learned counsel appearing for the respondents.
In view of the aforesaid, without going into the merit, the present OA is disposed of, with a direction to the respondents to consider the applicant’s aforesaid pending representation dated 09.08.2021and to dispose of the same by passing an appropriate reasoned and speaking order and preferably within six weeks from the date of receipt of a copy this order.
The OA is disposed of in the aforesaid terms. No costs.
