Judgment

Learned counsel for the opposite party No.8 submits that already vide letter dated 12.02.2021, Sr. Treasury Officer, Jahanabad was directed to pay
the amount of Rs.2,12,579/- by the Sr. Accounts Officer, Patna and subsequently, vide letter dated 17.02.2021, Treasury Officer directed the Branch
Manager, Punjab National Bank, Noawan, Jahanabad to release the said amount in view of the order passed by this Court. He draws the attention of
the Court towards page 15 to the show cause and submits that email dated 18.02.2021 sent at 2.50 PM shows that the Branch Manager, Punjab
National Bank, Noawan Branch, Jahanabad is aware of the order passed by this Court regarding payment of the said amount.
Mr. Chanchal Jain, learned counsel for the petitioner makes an honest submission on the basis of passbook, received from the petitioner that till date
the said amount of Rs.2,12,579 has not been reflected into the passbook, which is updated on 10.06.2021, neither the said amount is received by the
petitioner.
The learned counsel for the petitioner is directed to implead Branch Manager, Punjab National Bank, Noawan Branch, Jahanabad as a party opposite
Party Nos. 9 in the array of the parties.
Let a specific affidavit be filed by the Branch Manager, Punjab National Bank, Noawan Branch, Jahanabad regarding disbursement of the entire
amount of Rs.2,12,579/- for which the petitioner is entitled, within a period of three weeks. It is made clear that if the amount is not disbursed, within
the aforesaid period and affidavit to that extent is not filed, Branch Manager, Punjab National Bank, Noawan Branch, Jahanabad shall remain
physically present before this Court on the next date of hearing through Video Conferencing to explain as to why a Cont. proceeding be not initiated
against him for flouting the Court’s order.
Office is directed to communicate this order through the Superintendent of Police, Jahanabad to newly added opposite party No.9- Branch Manager,
Punjab National Bank, Noawan Branch, Jahanabad, by 15.06.2021.
