1.

The petitioner is before this Court seeking for the following reliefs:

a. Issue a writ of mandamus by directing the Respondents taking into consideration of the petitioner’s request and to extend his parole period granted by this Hon’ble Court in W.P.No.9450/2025 dated 02.04.2025 vide Annexure-C.

b. Grant such other reliefs that this Hon’ble Court deems fit to be grant in the facts and circumstances of the case, in the interest of justice and equity.

2.

Learned AGA accepts notice for respondents No.1 to 4.

3.

The above petition has been filed seeking for extension of parole granted by this Court vide order dated 2.04.2025 in W.P. No.9450/2025. This Court vide the aforesaid order taking into consideration the medical conditions of the detenue, the requirement to undergo surgery had granted emergency parole of 15 days.

4.

Learned counsel for the petitioner submits that the surgery could not be conducted and necessary arrangements are being made for the surgery to be conducted, which would be so done within next 15 days.

5.

Taking into consideration the nature of ailments, more particularly the diagnosis made of diabetic foot having gangrene requiring skin grafting or amputation of second toe, I am of the considered opinion that the parole which had been granted earlier would be required to be extended by another period of 15 days. It is made clear that no further extension of parole would be granted if the surgery not to be got to be conducted within 15 days, no further request would be entertained.

6.

Hence, I pass the following:

ORDER

i. The writ petition is allowed.

ii. Manadamus is issued to consider the petitioner’s request for extension of parole by 15 days.

iii. Orders to be passed by respondent No.2 by the end of the day 17.04.2025.
