Judgment
Nobody appears on behalf of the other Respondents.
Evidence affidavit was earlier filed on behalf of the Petitioner on 2.11.2022 which is available on record of the case. Subsequent thereto, Respondent No.1 has also filed their evidence affidavit which was duly received by the Registry of this Court on 21.2.2023. The evidence affidavit filed on behalf of the Respondent is also taken on record.
The matter was earlier listed before the Hon'ble Bench for disposal of M.A.No.138 of 2023 and the Hon'ble Bench by the Order dated 31.8.2023 was pleased enough to observe that the connected M.A. shall be taken at the time of final hearing and the matter was remanded to this Court for taking evidences and framing of Issues.
Two weeks time is granted to the Respondent No.3 by way of last indulgence for filing their evidence affidavit, if any, failing which, the matter shall proceed further for recording cross-examination of the witnesses whose evidences have been filed on behalf of the parties. Let the matter be listed for "Directions" on 9th October, 2023. Since nobody appears on behalf of the Respondent No.3 and the matter is proceeding against Respondent No.2 ex-parte, let a copy of this Order be sent to the learned counsel for Respondent No.3 through e-mail for information and doing needful.
