Judgment

The petitioner has challenged Vacation Notice No. PEWN/Qtr. Vacation Notice/2020/464-66 dated 10.07.2020, whereby he has been directed to vacate and handover the possession of Quarter No. 16, Block-PHQ-3, Gulshan Ground, Jammu, which was occupied by him while serving in the Police Department. He hails from Baramulla and has superannuated as Inspector of Police on 30.04.2020. He has stated that he had served in the militancy affected areas and was granted out-of-turn promotion by the Police Department vide order No. 424 of 1998 dated 19.02.1998 as Assistant Sub Inspector. Since 1994 he had been posted in Civil Secretariat in the Security Wing of the J&K Police and because of threat perception, aforesaid quarter was allotted to him in the year 1999 where he is residing along with his wife and daughter. Because of threat perception, he is not in a position to go to his native place i.e. Baramulla and his house at Trikuta Nagar Extension is under construction and it will take about six months to complete. On superannuation, respondent No. 4 issued the impugned vacation notice, whereby he has been directed to vacate and handover the possession of the aforesaid quarter to Estate Wing Jammu, failing which, he would be evicted forcibly. Having threat of forcible eviction, he approached this Court by way of this writ petition seeking quashing of the impugned vacation notice.
During the course of arguments, learned counsel for the petitioner, submits that he would be satisfied if he is given reasonable time for vacating the quarter in question so that he is in a position to make arrangement for alternative accommodation.
Mr. Raman Sharma, learned AAG appearing for the respondents submitted that if one month's time is given to the petitioner for vacating the quarter in question, he has no objection and writ petition can be disposed of with such direction.
Having regard to the grievance of the petitioner and the relief sought coupled with the submissions made by the learned counsel for both sides, this writ petition is disposed of with a direction to the respondents to allow the petitioner to remain in possession of the quarter in question till 31.08.2020. Petitioner shall vacate the premises on or before 31st August 2020 and in case of failure, respondents are at liberty to evict him from the said quarter.
Disposed of as above.
