Judgment
In terms of the order dated 22.02.2022 the Reply Affidavit has been sanitized and put on record.
Heard Leaned Counsel for the Appellant. The Appellant has preferred the instant Appeal praying for expedited hearing of Company Petition No. 1202(MB)/2020 sub judice before the Hon’ble National Company Law Tribunal, Mumbai wherein the Appellant has been aggrieved by the order dated 07.09.2021 in CA-208/2021 in CP-1202(MB)/2020 wherein it has been recorded that due to paucity of time the matter is adjourned to 07.10.2021.
The Learned Counsel for the Respondent Nos. 1 and 2 in his Reply Affidavit at para 3 stated that the averments made in the Original Company Petition No. 1202(MB)/2020 are sub judice before the Hon’ble National Company Law Tribunal, Mumbai.
In view of the circumstances, we dispose of the instant Appeal with the request to the Ld. National Company Law Tribunal, Mumbai to expedite the matter and dispose of at an early date.
With the aforesaid observation, the instant Appeal is disposed off.
