The present criminal appeal has been filed by the Appellant/Accused No.4 seeking to set aside the Order passed in Crl.M.P.No.1644 of 2024 in Crime No.272 of 2024 on the file of the Court of Special Judge for trial of cases under SCs & STs (PoA) Act, 1989-cum-IV Additional Sessions Judge, Guntur, dated 21.11.2024 and to release him on bail.

The Appellant herein is Accused No.4 in Crime No.272 of 2024 of Mandapeta Town Police Station. The offences alleged against the Appellant are under Sections 140(4), 126(2), 115(2), 351(2), 79 read with 3(5) of the BNS and Section 3 (1) (r) (s), 3 (2) (va) of SCs and STs (PoA) Act, 1989.

Heard Sri N.Siva Reddy, learned counsel for the Appellant and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Notice was served on the DE-FACTO complainant, none represented.

Learned counsel for the Appellant would submit that the Appellant has been in judicial custody since 02.11.2024. Learned counsel would further submit that the Appellant has no criminal antecedents except the present case. Learned counsel would further submit that Accused Nos.1 to 3 and 6 to 9 in the present crime were enlarged on bail VIDE Order dated 17.12.2024 passed in Crl.A.No.767 of 2024 by this Hon’ble Court and the present Appellant is on the same footing. Learned counsel would further submit that the Appellant is ready to furnish the sureties to the satisfaction of the Court and obey any conditions that may be imposed in the event of grant of bail. Learned counsel further would submit that crucial part of the investigation might have completed and the question of tampering with the evidence does not arise. Learned counsel finally prays to release the Appellant on regular bail.

Learned Assistant Public Prosecutor would submit that Court may pass appropriate orders.

Considering the submissions made and a fair look at the material placed on record and also the stage of the investigation, this Court is inclined to enlarge the Appellant on bail on the following conditions:-

(i) The Appellant/Accused No.4 shall execute a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for like sum each to the satisfaction of the learned Special Judge for Trial of Cases under SCs and STs (PoA) Act-cum-X Additional District Judge at Rajamahendravaram.

(ii) The Appellant/Accused No.4 shall appear before the concerned Station House Officer once in a week i.e., on Sunday, between 10.00 a.m. to 05.00 p.m., till filing of the charge sheet.

Pending miscellaneous applications, if any, shall stand closed.
