Judgment
A.S. Pachhapure, J.—The Petitioner has been arrested for the offence punishable u/s 379, 120(B) of IPC Section 3 & 7 of Essential Commodities Act, 15(2) of Petroleum Mineral Pipeline Act 1962 for the theft and extraction of diesel from the pipeline laid in between Mangalore and Hassan.
It is the submission of the learned Counsel for Petitioner that the marriage has been fixed on 09.04.2011 and 10.04.2011 and that the marriage cards have been distributed. In the circumstances the counsel prayed to grant bail for a period about three months. The marriage invitation has been produced and perusal of the same reveal that the marriage of the Petitioner has been fixed on 09.04.201 land 10.04.2011.
Taking into consideration the ground made out, I think that the Petitioner is entitled to bail for certain period.
Hence the petition is allowed. The Petitioner is granted bail for a period of three months from the date of this order on his executing a personal bond for a sum of Rs. 50,000/- with two solvent sureties for the like sum to the satisfaction of the Magistrate with further following conditions:
1) The Petitioner shall surrender before the Magistrate/Police on 07.07.2011.
2) He shall not, directly or indirectly, make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
