Learned counsel for the petitioner submitted that the order passed by this Court dated 15th May, 2009 in W.P. (S) No. 117 of 2005 has not yet been complied with.
Learned counsel for the respondent-C.C.L. submitted that now a detailed speaking order has been passed by the Chief General Manager, Piparwar Area, P.O. Bachra, Dist. Chatra on 2nd March, 2012, which is annexed at Annexure-A to the show cause. Thus, the order passed by this Court dated 15th May, 2009 has been complied with.
It is further submitted by learned counsel for the respondent-C.C.L. that now a Committee has been constituted of following three members for redressal of the grievances of the retired employees of the CCL:
(i) General Manager (Fin.), CCL or his representative;
(ii) General Manager (P & IR), CCL or his representative; and
(iii) Dy. General Manager (Pen), CCL or his representative
In view of this statement and looking to the show cause filed by the opposite party nos. 2 and 3 and also looking to the order passed by the C.C.L. dated 2nd March, 2012, which is at Annexure-A to the show cause, there is no disobedience of the order passed by this Court dated 15th May, 2009 in W.P. (S) No. 117 of 2005.
The Court appreciates the appointment of the Committee by the Central Coalfields Limited for redressal of the grievances of the retired employees. It is expected from the Central Coalfields Limited that the aforesaid Committee will convene a meeting more than once in a month because several cases are pending regarding grievances of the retirement benefits of the retired employees of the Central Coalfields Limited.
In view of the aforesaid facts, there is no substance in this contempt application and, hence, the same is, hereby, dismissed.
The officer, namely, Sri Kandula Sibanavoyar Patra, S/o Late K. Madhusudan Patra, General Manager (P & IR), Central Coalfields Limited is present in the Court and his presence is not required.
