Sh. Padma Kumar S., learned counsel appeared for the applicants. Sh. Shubham Pundhir appeared as proxy to Sh. Rajeev Kumar, learned counsel for the respondents.

M.A. No. 2859/2015

The MA, filed for joining together of the applicants, is allowed for the reasons stated there in the MA.

O.A. No. 3246/2015

The applicants herein, are working in Intelligence Bureau (in short, IB) as Stenographer Grade 'D'. Some of them have since been promoted also.

The applicants preferred the instant OA, seeking benefit of 'Non Functional Selection Grade' (in short, NFSG), which was granted to similarly placed Stenographer Grade 'D' in Central Secretariat Stenographers' Services (in short, CSSS) vide DoP&T Office Memorandum dated 22.06.2011. During the pendency of the OA, respondents have issued letter dated 06.08.2018, wherein this benefit has been granted w.e.f. 01.01.2016 on notional basis and w.e.f. 06.08.2018 (the date of order) on actual basis.

In view of the above, the learned counsel for the applicants pleaded that the applicants wish to withdraw the instant OA with liberty to seek the same benefits w.e.f. an earlier date as per OM dated 22.06.2011 as was granted to similarly placed Stenographers Grade 'D' in CSSS, by making a representation to the respondents, failing which by filing another OA.

Matter has been considered.

In view of the fair submission made by the learned counsel for the applicants, the OA is disposed of as withdrawn with the aforesaid liberty. No order as to costs.
