Judgment
Heard learned counsel for the parties.
Though, on 06.10.2016, the Court had observed that the
proposed election of the Chief Councillor of Mirganj Nagar Panchayat
shall be subject to the result of this writ petition but it was also
observed that the point raised in the writ petition would require
consideration at length. Due to efflux of time, which is not attributable
to the petitioner and only systemic, still the position is that the
notification for constituting a fresh body of Mirganj Nagar Panchayat
is due next month, that is, April, 2017, in the considered opinion of
the Court, no useful purpose would be served to deliver an order on
merits of the matter. The Court can only observe that only on this
ground, as such exercise, even if interference is made by the Court,
will not result in any substantial relief to the petitioner as the term of
the Body itself is almost over. However, the Court would hasten to
add that non-interference is not a comment or any expression of
opinion on the merits of the matter. Further, the Court does not find
that any substantial question of law is involved, and even otherwise,
as the matter basically involves issues of fact and the technicalities
based on such facts in light of the statutory provisions, does not
persuade the Court to interfere.
In view thereof, the writ petition stands disposed off.
