2/12.08.2026 Heard learned counsels for petitioner and for State.

The petitioner is apprehending his arrest in connection with Senha P.S. Case No.85 of 2024, for offence registered under section 316(5), 318(4), 3(5) of BNS, 2023, pending in court of learned S.D.J.M., Lohardaga.

Learned counsel for petitioner submits that the petitioner happened to be Computer Operator in the Office of the Block Development Officer and the allegations are made of withdrawal of MNREGA money to the tune of Rs.49,619/- and so far as this petitioner is concerned by way of referring Annexure-2, he submits that the said amount has been deposited by the petitioner in the office of the Block Development Officer, Senha, Lohardaga. He next submits that the co-accused who has also deposited the amount earlier, has been granted anticipatory bail by this Court in ABA No.534 of 2025 and ABA No.2624 of 2025 and the petitioner has got no criminal antecedent as disclosed in paragraph no.9 of the petition and on these grounds, he submits that anticipatory bail may kindly be granted.

Learned State counsel opposes prayer and submits that the allegations are there of withdrawal of MNREGA money to the tune of Rs.49,619/-.

Annexure-2 is the receipt which has been issued by the Nazir of Block Development Office. Thus, the amount as alleged against the petitioner has been deposited and in the identical situation the co-accused persons have been granted anticipatory bail as aforesaid and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M., Lohardaga, in connection with Senha P.S. Case No.85 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
