Bimlesh Kumar Jha vs The State of Bihar and Others

Appellant Bimlesh Kumar Jha filed a writ petition being CWJC No. 13399 of 2001, in effect, resisting an employment given to him under the principle of rule of harness. He also resisted the place of posting. The employment given to him by the State of Bihar was as a Class-IV post. His father was also on the same post.

The contention of the Appellant-Petitioner was that as he has qualifications the employment offered to him must be a category 111 and his posting must not be to the place which has been indicated. In effect, the learned Judge hearing the petition declined to interfere leaving a situation that the Appellant-Petitioner had his appointment on a Class-IV post and the posting as was indicated.

Unsatisfied the Appellant Petitioner filed the present letters patent appeal.

This Court has no further comment on this petition except that Appellant-Petitioner is fortunate enough to have received an employment when millions are unemployed.

The order on the writ petition does not call for any interference.
