Judgment

These are applications for pllacing on record reply on behalff of the respondent in CM-14214-CWP-20244 and short reply on behalf of the respondennt along with Punjab Governmment memo dated 22.02.2021 and representaation dated 25.02.2021 submitted by petitioner as Annexure P-8 and Annexure P-9 respectively in CM-19319-CWP-2024 and Punnjab Government memo dated 22.02.2021 annd representation dated 25.02.20021 submitted by the petitioner as Annexure P-8 and Annexure P-9 respectivvely in CM-19320-CWP-2024.
Keeping in view of the contents mentioned in the applications, the same are allowed. Reply on behalf of the respondent-GNDU, short reply on behalf of the respondent along with Punjab Government memo dated 22.02.2021 and representation dated 25.02.2021 submitted by petitioner as Annexure P-8 and Annexure P-9 respectively in CM-19319-CWP-2024 and Punjab Government memo dated 22.02.2021 and representation dated 25.02.2021 submitted by the petitioner as Annexure P-8 and Annexure P-9 respectively in CM-19320-CWP-2024, are taken on record subject to all just exceptions.
Learned counsel for the petitioner submits that it is only due to non-passing of the Refresher/Orientation Course, the date of promotion of the petitioner as Associate Professor has been delayed, which Course is not mandatory hence, the respondents are liable to consider the said aspect in order to decide whether the claim of the petitioner for promotion as Associate Professor from 04.09.2012 is admissible or not.
Learned counsel for the respondent-University submits that in case, any such documents is brought before the respondent-University, due consideration will be given to the said aspect and an appropriate order will be passed within a period of 8 weeks from the receipt of any such representation along with the documents concerned and in case, it is found to accept the claim of the petitioner, the same will be accepted, otherwise due reasons will be mentioned for not accepting the claim of the petitioner in the speaking order to be passed and the said order will be duly conveyed to the petitioner.
Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further with liberty to file appropriate representation.
Ordered accordingly.
Pending application, if any, also stands disposed of.
