Judgment
D.A. Mehta, J.—The petition had been preferred seeking direction to the respondent authorities to make payment of pension and gratuity to the petitioner who is widow of late Shri S.J. Moria, who was serving as Medical Officer, Ayurved with the respondent panchayat.
Learned Assistant Government Pleader submits that the final payment as per revised pay scale was made on 11.7.2002 on the basis of the higher payscale effective from 21.2.1998.
On behalf of the petitioner it was submitted that appropriate direction to pay interest for the belated payment may be made.
Considering the fact that the revised pay scale is operative from 21.2.1998 and the payment of retiral benefits has been made on 11.7.2002 the respondents are directed to pay running interest @ 10% p.a. on the total amount of payment, which is stated to be Rs. 15,000/- (rounded of), with effect from 1.3.1998 up to 11.7.2002. The interest shall be paid by the respondents to the petitioner within a period of six weeks from today without waiting for certified copy or a writ of this order. The learned Assistant Government Pleader to communicate the direction accordingly to the respondents. The petition is accordingly partly allowed in the aforesaid term. Rule is made absolute to the aforesaid extent with no order as to costs.
