Judgment
Kurian Joseph, C.J.—The writ petition is filed with the following prayers:
(i) That the order No. 200117/Rec./JE (E)/JC/2000-5206-08 dated 27.06.2000 Annexure A-VIII be quashed and declared null and void.
(ii) That the respondents be directed to implement Annexure A-VII and appoint applicant as junior Engineer (Elect.) as per Ex- servicemen quota for the posts.
In the reply, it is stated as follows:
The applicant herein had the right of consideration of his candidature for the post of J.E. (E) against unserved 41 posts being Ex-Servicemen in open competition, but can not seek his selection against the posts filed on batchwise recruitment of unemployed diploma holders. The upper age limit in the case of Ex-Servicemen in terms of H.P. Govt., Notification dated 28.8.82 would only be relaxable in open competition for direct recruitment against un-reserved posts. It is therefore stated that these instructions contained in annexure A7 are not applicable on batchwise recruitment.
In case the petitioner has any dispute with regard to the position stated above, it will be open to him to approach the first respondent in which case the matter will be duly considered by the first respondent in accordance with law and justice within a period of four months.
With the above observations, the petition stands disposed of so also the pending application(s), if any.
