Judgment
Hon''ble Prafulla C. Pant, J.—Mr. Karan Anand, Advocate, present for the applicants. Mr. M.A. Khan, Brief Holder, present for the State.
Heard.
Applicants- Bijendra Singh and Babu Ram, who are in jail in connection with Crime No. 193 of 2011, relating to offences punishable u/s 420 and 120B of I.P.C., Police Station Kotwali Laksar, District Hardwar, have sought their release on bail.
Learned counsel for the applicants submitted that the First Information Report is delayed by more than three years. Land was sold in the year 2007, and the F.I.R. is lodged in the year 2011. It is further pointed out that co-accused Satpal has already been granted bail. Applicant is in jail since December, 2011. Learned counsel for the applicants further pleaded that the applicants are innocent, and falsely implicated.
In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that the applicants deserve bail. The Bail Application is allowed. Let the applicants- Bijendra Singh and Babu Ram be released on bail on executing personal bond by each one of them, and furnishing two sureties, for each one of them, each of the like amount, to the satisfaction of Additional Chief Judicial Magistrate, Laksar. (Urgency Application No. 1283 of 2012 stands disposed of).
