Judgment
Prafulla C. Pant, J.—Mr. P.C. Petshali, Advocate, present for the applicants.

Heard.
Applicants Surendra and Rampal Singh, who are in jail in connection with F.I.R. No. 50 of 2011, relating to offences punishable u/s 457, 380, 411 of I.P.C., Police Station-Kunda, District- Udham Singh Nagar have sought their release on bail.
Applicants are in jail for more than three months. Recovery is said to have been made from six accused. Applicants have no criminal history. Only one Intezar is said to have criminal history, he is not applicant in this case. Co-accused Shanti Swaroop and Naresh with similar role have already been directed to be released on bail.
In the above circumstances, without expressing any opinion, as to the final merits of the case, this Court is of the view that the applicants deserve bail.
The bail application is allowed. Let the applicants Surendra and Rampal Singh, be released on bail on their executing personal bond by each one of them and furnishing two sureties for each one of them, each of the like amount, to the satisfaction of the Additional Chief Judicial Magistrate, Kashipur.
