Judgment

Mr. M.L.Nongpiur, learned counsel has entered appearance today on behalf of the respondent No. 3.
Mr. R.Kharkrang, learned counsel for the petitioner submits that with regard to the respondents No. 4 & 5, the said respondents have also been served, as such, he prays for and is allowed to file an affidavit indicating service on the said respondents before the next date.
Dr. N.Mozika, learned DSGI assisted by Ms. C.Jala, learned counsel for the respondents No. 1 & 2, has submitted at the bar that the respondent No. 3, which is an Organisation purported to be an Association of Ex-Servicemen did not obtain an NOC for registering the said Association, and as per verified reports, the respondent No. 3 is said to be engaging in collecting donations amounting to lakhs from Ex-Servicemen. He submits that there being a legitimate Ex-Servicemen Association is existence, the conduct of respondent No. 3 calls for some interim orders. In this context, the learned DSGI has produced documents relating to donations collected from Dehradun District, Uttarakhand and Nepal, which shows that a large number of Ex-Servicemen have given donations.
In this view of the matter, in order to avoid further complication, the respondent No. 3 is directed in the interim, to refrain from collecting any donations from any Assam Rifles Ex-Servicemen.
Mr. M.L.Nongpiur, learned counsel for the respondent No. 3, though vehemently opposing this direction is given liberty to file a detailed affidavit and also an application for vacation of this order, if necessary.
