The petitioner Bijaya Kumar Dunguri has filed this revision petition challenging the impugned order dated 09.12.2020 passed by the learned Sessions

Judge, Jharsuguda in S.T. Case No.34 of 2014 in rejecting the petition filed by the petitioner for correction of his father’s name in the cause title of

the judgment to “Jagannath Dungriâ€​ in place of “Raghunath Bagâ€​.

Learned counsel for the petitioner submitted that the learned Sessions Judge, Jharsuguda has directed for holding an inquiry in terms of the order

passed by this Court in W.P.(C) No.27737 of 2020 and even though the inquiry report was received in favour of the petitioner to the effect that his

father’s name is Jagannath Dungri but all the same, the learned trial Court has rejected the petition in correcting the father’s name in the

cause title of the judgment mainly in view of the bar under section 362 of Cr.P.C. and held that the Court cannot correct such error after

pronouncement of the judgment.

Issue notice on the question of admission indicating therein that the matter shall be disposed of at the stage of admission.

Since the State of Odisha is the sole opposite party and Mr. S.S. Pradhan, learned Addl. Govt. Advocate has already received the copy of the revision

petition, list this matter on 08.07.2021 for final disposal.

Instruction, if any be obtained in the meantime.

Mr. Pradhan shall also apprise this Court about the case laws as to whether this Court by exercising revisional jurisdiction or inherent power under

section 482 of Cr.P.C. can order for making necessary correction regarding the father’s name of the petitioner in the cause title of the judgment

passed by the learned trial Court.
